Unlicensed Drunk Teen Driver May Face 15 Years to Life in Prison
July 29, 2009
Santa Ana – Milad Moulayi, 18, of Tustin may get sentenced 15 years to life in prison after a drunk driving accident which killed Mackenzie Frazee, 16 in August 2008.
Moulayi, who was 16 years old and unlicensed at the time of the accident, took his mother’s 1998 Mercedes-Benz sedan to drive Frazee home from his house party. Prior to driving, Moulayi was said to have downed 10 shots of Sailor Jerry rum.
He was found to have been speeding in excess of 100 mph on Newport Avenue before he lost control of the car. The intoxicated teen drove over the median and knocked over two road signs before he crashed into a concrete light pole which split the Mercedes in two.
Moulayi suffered minor cuts and bruises while his passenger Frazee, who was wearing a seat belt, died from massive blunt-force trauma at Western Medical Center. At the time of the accident, Moulayi had a blood alcohol level of .11 percent.
According to Deputy District Attorney Susan Price who is currently prosecuting Moulayi’s case, the teen was warned not to drive because he was drunk. The prosecutor also said that 13 hours before the fatal drive, Moulayi’s learner’s permit for driving had been suspended by the juvenile court judge and was warned that getting behind the wheel amounted to great responsibility.
The prosecution is aiming to get Moulayi convicted for second-degree murder as he knew driving while intoxicated was dangerous to human life but still did the wrong thing. Also, Moulayi who is being tried as an adult is charged with driving without a license.
